You've just had fun reading a dense license agreement! Outside the realm of copyright, but not too far, this is a liberal license agreement, and I've had students come to me before with iStockphoto projects. It's out of  Canada,and this product is-for them-unusually liberal.

Some of your contradictory-sounding quotes are because you are reading the permitted uses for the word &quot;Content&quot; [i]as if it were your proposed content.[/i] It really means 'the file' that you will get from them, not the use within your final ppt presentation. 

[b]Content License Agreement[/b], [b]#3 Permitted Standard License Uses:[/b], (b) is Seat Restrictions and here you see the reference to Content being installed and used in only one location at a time. So you'll get the file and use it on one computer, it is not talking about your (finished) intellectual content (with the licensed property) that will be published online. You can take that original file to another computer, though, to continue working with it, just not have it resident on multiple computers simultaneously.

It shows up again in [b]#4 Standard license Prohibitions, number 11:[not] install and use the Content in more than one location at a time or post the Content ...on a server for use by others.[/b] Do you remember Napster? This is referring to that sort of multiple site/multiple file download and use. You will license something from iStockphoto and then use it within your ppt presentation. Again, it's not &quot;the Content&quot; as in these sections.

It's very clear what you can do, to use the Content for permitted uses as defined in [b]2. Standard License Terms 'Unless the activity or use is Permitted, you cannot do it':
#3 (c) Permitted Uses: Subject to prohibited uses.....the following are permitted:[/b] 
**The issue here is that your use does not neatly fit in to [b]1) ad &amp; PR materials, 2) entertainment, 4)prints/posters for personal or PR use.[/b]  
You might fit in [b]3) online or electronic publications.[/b] 
(All these are to be not for resale or license, which should be within your intent to put your lecture online.)

The other document you need to abide by is the second 'primary' document, the [b]Terms of Use[/b]. Here is where you might want to present your use as educational but not personal, and publicly accessible: 
[b]Intellectual Property section
Materials may only be used and copied for your own, non commercial, personal, or educational purposes.[/b]

 Your use is [i]not strictly educational[/i]–it is not for a course, but for others with interest in learning to use and learn?  Generally, the courts favor traditional educational situations when considering exemptions. While contracts and licenses trump copyright, this   says that [b]their licensors may be protected by ...laws relating to copyright.[/b]

This  would make me pause if I were posting my presentation on line,  because you will be engaged in [i]an exclusive right that is not yours by virtue of licensing[/i]--distribution. The web is an instant publisher and distributor. iStockphoto gives you license to use  an image in something of yours, for personal or PR use, but the web makes copies and distributes them, and that's a right held by iStockphoto and/or the creator.

Copyright is a balance of exclusive rights owned by someone or an entity like this company, to copy, distribute, revise, publicly display, and publicly perform. While they are generous with you in using it within a ppt and for your own use, it might not fit neatly in educational use.

- Consider keeping the image very small for the online posting of your ppt. 
- Generously credit the image creator and the licensing body, iStockphoto, along with whatever license number they give you. 
- Use it in small format, without altering or adapting the image. [b]Terms of Use[/b] specifies  the 'do not modify or make a derivative work' principle of copyright, and making it small doesn't infringe.

Use it all as a teaching moment, too– mention in your lecture that the image may appear small in the online posting of your presentation, to abide by license and copyright agreements. If you feel at risk, use the option given to you after #5 of Permitted Uses, [b]contact the iStockphoto's Client Relations for guidance.[/b]

Putting filmed lectures online is the new rage, and it's good to ask about what's permitted and what does not put you at risk either of your license or of someone else's copyrights. The fact that technology makes it easy is not well received in court today, we're expected to learn more, and ask more, first. The person who asked recently to use the NOVA film clips in the lecture (later to be posted on YouTube) learned that NOVA allowed the first use via the web [not download] and also was explicit in prohibiting redistribution (YouTube). Your situation is more liberal.

Clear as mud? Not really. I'll be away from work for 9 days...but am always ready to talk real-time with someone about copyright and acceptable use!  It is easier in person!

A large part of this is PowerPoint presentations, and I need help understanding the rights for any images we put in the PowerPoint. We're considering using iStockphoto, and their license agreement permits use for:

&quot;on–line or electronic publications, including web pages to a maximum of 800 x 600 pixels&quot;

but also prohibits us to:

&quot;install and use the Content in more than one location at a time or post a copy of the Content on a network server or web server for use by other users&quot;

or:

&quot;use or display the Content in an electronic format that enables it to be downloaded or distributed via mobile devices or shared in any peer-to-peer or similar file sharing arrangement&quot;

This seems almost contradictory.  Anyone have experience with this?]]></description>

Its amazing how you don't even really realize the building is there until someone points it out. I'm surprised it hasn't been demolished and something else built there, since there is a lack of space on campus. Perhaps because there's still a large mercury spill? Excellent question!

First off, KSL- the building and physical collection- IS available to outside researchers, so if your friend wanted to, she could come in, ask for help from the reference desk, look up books in our collection, and even use our public access computers to use our online databases.

However, there ARE a lot of ways to conduct some pretty darned good research using publicly available resources.  One is to saunter into a public library :-)  Remember that Cleveland Public Library's downtown branch is an excellent research library.  Also, if your friend has a public library card- Cleveland Public Library system, Cuyahoga County, or wherever she lives, many times those systems have online database/journal access for their users- she can even use these sources from home with her library card number.  Your tax dollars at work, so USE IT!

If you want non-library, publicly available stuff, remember to look at WHATEVER information you find with a critical eye.  So if you and your friend surf Google or Wikipedia and find web pages with information, think about AUTHORITY of the source, BIAS of the source, CURRENCY of the source, etc.  (This isn't just for web sources, of course!)

If you want academic research, remember Google Scholar (http://scholar.google.com) which will point to academic publications, both books and articles (though not all will be available freely via the web, sometimes you'll be limited to abstracts).  Google Books will search through full text of hundreds of thousands of books, both new and old (though most of the new ones will only show you snippets- at which point, pull out that library card!)

These are just a few ideas.  If you want more ideas specific to the topic, I'd be glad to give you more, but perhaps with the above pointers the two of you can give it a go and see what you find.]]></description>

      <description><![CDATA[Hi!

    I'm currently attempting to help a friend do some research for a class debate project on animal rights.  It entails preparing a short paper defending her side (in her case, pro-animal rights), as well as having a mock, in-class debate.  She is, admittedly, not a Case student, so she doesn't have access to either the Case online resources, or Case's libraries themselves.  It's been a while since I've done research in the context of completing an academic assignment, and this is her first college-level class, so we're both a bit in the dark as to how best to go about researching a topic such as this to find citable sources (my default answer is to Google everything, but I have a feeling that there are better publicly available resources than that for research like this).  

    Do you have any suggestions on doing research for this topic, or advice in general on good starting points for academic research using publicly available content?

One other thing, I just did a simple Google search for Hassel Tippit and found some interesting documents that may illuminate who he was for you- for example there are some professional talks and papers that he gave and wrote dealing with accounting which will go a long way towards telling you who he was in his professional life.  I'm not sure if this is what you are looking for when you ask for information about him, but I think it is some interesting documentation.

(In addition to being an indicator of the age of Google, in which we can find, almost instantaneously, relatively obscure publications from a half-century ago!)]]></description>

I would recommend that you contact the University Archives to see if they have any more information on Tippit.  I'm guessing they probably do.  I did a quick check in the Encyclopedia of Cleveland History and didn't turn up anything. I cannot find any information on Hassel Tippit, other than he was a Trustee and a Consultant from Ernst &amp; Ernst, which later became Ernst &amp; Young.

He should have more information on him if we dedicated a residence hall in his honor.

There is an excellent CaseLearns class being offered on March 19th on using RefWorks.  Their online tutorials are good, but this would be an excellent opportunity to learn RefWorks from the ground up.

      <description><![CDATA[We subscribe to all the IEEE journals through IEEE Xplore, so I would not recommend searching from the OhioLINK catalog.

Also, I do not know about searching from EndNote. It would seem that would restrict how you search. IEEE has a button to automatically import reference into EndNote as you find them.

I know IEEE closely monitors excessive usage and it might block people from using EndNote this was as it would be an easy way to harvest all their data.

You may want to contact the librarians at the Health Center Library. They utilize and teach EndNote more than the KSL staff. At KSL we push the online RefWorks instead.]]></description>

I am mainly trying to search IEEE journals with EndNote.  I realize I can do this directly through IEEE Xplore or the OhioLink central catalog, but I'd like to do it through EndNote so that the program will store the reference data automatically.

      <description><![CDATA[You don't specify what at OhioLink you are trying to search with EndNote.  The OhioLink central catalog should work fine with or without VPN.  

If you are trying to use anything else at OhioLink (EJC, EBC, databases) and you are doing so either on campus/wireless or off campus, then as David suggests, you'll need to fire up VPN.

I'm not an EndNote user either, but we'll get this sorted out for you!]]></description>

I am a new graduate student and I am just starting to use Endnote at CWRU.  Back when I was at the University of California, I was able to connect directly to the UC library through Endnote and find articles. Angela-

You might need to alter your search terms slightly- I believe the term is &quot;frontispiece&quot;.  When so doing, our catalog has one title here:

http://catalog.case.edu/search/t?SEARCH=paintings+of+the+lotus+sutra

(it is out now, so you'll have to use Ohiolink to get it)

And more under the subject heading:

http://catalog.case.edu/search~S0?/dTripitaka.+Sutrapitaka.

A book like the following one is likely to have commentary on textual matters:

http://catalog.case.edu/search/t?SEARCH=Tao-sheng%27s+commentary+on+the+Lotus

I would imagine the bibliography in these books would also be helpful.

I also turned up quite a few articles on Sutra frontispieces searching JSTOR (http://www.jstor.org) for &quot;Sutra and frontispieces&quot;, so that is worth a try.

OK, I have a definitive answer, courtesy of Helen Conger of University Archives, as follows:

[quote]Regarding the UNIVAC computer- It was a gift to Case Institute of Technology in 1957. You are correct that it was housed in the Quail Building at that time. Quail was home to the Computing Center (later the A. R. Jennings Computing Center) until 1970 when it moved to Crawford. The computer was referred to as UNIVAC I. It was removed from the Center in the 1965-1966 academic year. Part of it was sold to the Chesapeake &amp; Ohio Railway Company that year.[/quote]
